TERMS & CONDITIONS

ACCEPTANCE OF TERMS, CONDITIONS, AND WAIVER OF LIABILITY
By registering for any Impact Hockey Development service, you agree to the following terms, conditions, and waiver/release of liability.

 

SERVICES OFFERED
Impact Hockey Development is a leading provider of on and off-ice activities, events, tournaments, games, hockey development, practices, and/or programs.

 

REGISTRATION AND PAYMENT POLICY

  1. Registration Process - To secure your participation in our programs or events, you must complete the registration and payment process. This includes providing all required information and agreeing to our terms and conditions.

  2. Payment Requirement - Full payment is expected at the time of registration. This ensures that your spot is reserved and enables us to effectively plan and allocate resources for the program or event.

  3. Accepted Payment Methods - We accept various forms of payment, including credit cards, Visa/debit cards, and bank account payments made through PayPal. A PayPal account is not required to process credit card or Visa/debit payments, as this can be done by checking out as a guest. Bank account payments, however, will require a PayPal account.

  4. Confirmation of Registration - Upon successful completion of your payment, you will receive a confirmation email that includes details about your registration and any additional information related to the program or event.

 

CANCELLATION AND REFUND POLICY

  1. Full Refund: Customers who provide more than 30 days' notice of cancellation are eligible for a full refund of any payments made.

  2. Credit Towards Future Service: Cancellations made with less than 30 days' notice will not qualify for a refund but will receive a credit equal to the amount paid, which can be applied towards a future service.

  3. No Refund Policy: Cancellations made within seven days of the scheduled service date are not eligible for any refunds or credits.

  4. Refund Process: Once your refund is processed, the payment will typically be returned to the original payment method within 3 to 5 business days. Please allow this time for the funds to reflect in your account, depending on your bank's processing times.

WAIVER OF LIABILITY AND ASSUMPTION OF RISK

NOTICE TO ALL IMPACT HOCKEY DEVELOPMENT PARTICIPANTS: WAIVER OF LIABILITY AND ASSUMPTION OF RISK - BY COMPLETING REGISTRATION YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE - PLEASE READ CAREFULLY

I am aware that the participation in Impact Hockey Development (hereinafter referred to as "IHD") activities, events, tournaments, games, hockey development, practices and/or programs has, in addition to the usual dangers and risks inherent in the sport of hockey, certain additional dangers and risks including, but not limited to, the danger and risk of collision with other participants and/or manmade objects (sticks, pucks, boards, ice), and I freely accept and fully assume all such dangers and risks and the possibility of personal injury, death, property damage or loss resulting therefrom.

RELEASE OF LIABILITY

In consideration of IHD permitting my participation in the aforementioned event/program/game I hereby agree as follows:

​

  1. To waive any and all claims that I may have against IHD and their directors, officers, employees, agents and representatives, and any volunteers in any way associated with the event/program/game, (all of whom are hereinafter collectively referred to as "the releasees");

  2. To release the releasees from any and all liability for any loss, damage, injury or expense that I may suffer or that my next of kin may suffer as a result of my participation in the event/program/game due to any cause whatsoever, including any negligence, breach of contract, breach of statutory duty of care, or breach of the occupiers' liability act on the part of the releasees;

  3. To hold harmless and indemnify the releasees from any and all liability for any property damage or personal injury to any third party, resulting from my participation in the event/program/game; and

  4. That this release of liability shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns in the event of my death.

DESCRIPTION OF RISK

In consideration of my participation in such programs, activities and events, I hereby acknowledge that I am aware of the risks and hazards associated with or related to ice hockey. The risks and hazards of ice hockey include, but are not limited to, injuries from:

​

  • Exerting and stretching various muscle groups;

  • Vigorous physical exertion, rapid movements and quick turns and stops on the ice;

  • Strenuous cardiovascular workouts;

  • Collisions with the rink boards, hockey nets and ice;

  • Being struck by hockey sticks and pucks;

  • Physical contact with other participants, resulting in injuries to the eyes, teeth, face, head and other parts of the body, bruises, sprains, cuts, scrapes, breaks, dislocations and spinal cord injuries which may render me permanently paralyzed;

  • Variations in ice surface;

  • Travel to and from competitive events and associated non-competitive events, which are an integral part of IHD's activities.

 

Furthermore, I am aware that:

  • Injuries sustained in ice hockey can be severe;

  • I may experience anxiety while challenging myself during the activities;

  • Despite the rules in place, violations and/or accidents will occur and may result in injury; and

  • My risk of injury increases as I become fatigued.

  • Despite safety protocols put in place, there is risk of contraction of communicable disease, including but not limited to COVID-19.

MEDIA RELEASE

I, the parent/guardian of the Registrant, hereby grant to IHD, the right and permission, free from approval, review or cost, to photograph, record or otherwise capture the Registrants likeness in participating in the Programs for use in media, including, but not limited to pictures and video, to copyright the same in its own name, and which may be included in whole or in part for commercial or promotional use.

HEALTH AND SAFETY

Registered participants are encouraged to disclose any medical or health issues that may impact or prevent their ability to safely participate in any activity, program or event.

CHANGE TO SERVICES

Impact Hockey Development reserves the right to modify schedules, locations, or services due to unforeseen circumstances. Clients will be notified as soon as possible.

ACKNOWLEDGEMENT

I am of the full age of 18 years and THE PARENT/LEGAL GUARDIAN OF THE PARTICIPANT REGISTERED and I have read and understand this release of liability prior to signing it, and I am aware that by acknowledging this release of liability I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators and assigns may have against the releases.
